Smartdiet – Terms and Conditions
By registering to use Smartdiet products or services, you affirm your acceptance of these Terms and Conditions of use and agree to comply with them now and throughout the period of your use of Smartdiet' Products or Services and thereafter.
If you do not agree to these Terms and Conditions of use in their entirety, do not use Smartdiet Membership. If you wish to cancel your Smartdiet account after a change in the Terms and Conditions of use, you must do so by writing an email and request to cancel your account.
GOVERNING LAW AND ARBITRATION
These Terms and Conditions, its subject matter and Smartdiet IVS's and your respective rights under these Terms and Conditions shall be governed by and construed under the laws of Denmark.
Excluding the conflict of law provisions of that or any other jurisdiction. Any dispute arising between you and Smartdiet will be resolved by binding arbitration. The arbitration shall be conducted by a single arbitrator in Denmark. Unless otherwise expressly required by applicable law, each party shall bear its own attorneys' fees without regard to which party is deemed the prevailing party in the arbitration proceeding.
YOUR OBLIGATIONS AND RESPONSIBILITIES
– You are at least eighteen (18) years of age, or of the legal age of majority in your jurisdiction, and possess the legal authority, right and freedom to enter into Smartdiet's Terms and to form a binding agreement, for yourself or on behalf of the person or entity committed by you to Smartdiet's Terms.
You may not redistribute any information or recipes that can be found within your Membership page.
BILLING AND PAYMENT INFORMATION
Smartdiet does not store payment information. All payments are made through SSL encrypted connections, which ensures maximum safety for the transactions.
You acknowledge and agree that any card and related billing and payment information that you provide will be shared by Smartdiet with a third party partner, such as: payment processor and/or acquirer.
The cards accepted: Visa, MasterCard, Maestro, American Express, and Dinners Club.
You may terminate or cancel the services by giving Smartdiet written notice via the emil: email@example.com
You may discontinue to use and request to cancel your account and/or any Smartdiet services at any time.
Once we receive your cancellation request and have confirmed all the necessary information, we will inform you in writing that your account has been canceled.
Smartdiet may terminate your access to the services, in whole or in part, without notice in the event that:
– You fail to pay any fees due
– You violate this Agreement
– Your conduct may harm Smartdiet or others
In such event, Smartdiet shall not refund to you any fees paid in advance of such termination, and you shall be obligated to pay all fees and charges occured prior to the effectiveness of such termination.
Please note: Upon termination of the services for any reason, all recipes, and diet plans and information within the membership page will be made unavailable to you.
Do you want to make use of the right of your cancellation please write immediately after your purchase to our customer service by email: firstname.lastname@example.org and inform that you regret your purchase and wants to exercise the right of cancellation.
